Land in Sea Breeze Estate

We issued the following statement regarding land in Sea Breeze Estate.

Provided on 9 January:
There are no planning controls for Sea Breeze Estate, Indented Head,
under the Greater Geelong Planning Scheme relating to bushfire management. The
land was designated as being bushfire prone by the State Government.
We recommend that people look at land.vic.gov.au to see if land
is within a designated bushfire prone area. If it is, engage a suitably
qualified professional to undertake a BAL assessment prior to purchasing.
The City does not own the adjoining unconstructed road reserve that
backs on to properties in Annmaree Drive in Sea Breeze Estate. This is owned by
the Department of Environment, Land, Water and Planning (DELWP). At this stage
there are no plans to construct a road in this section.
The City has no legal power to issue a fire prevention notice to a
government agency, so the City cannot legally enforce or request the road
reserve to be cleared.

When this planning application was considered by Council in 2013 there were no planning controls under the Greater Geelong Planning Scheme relating to bushfire management.
Since then, on 12 December 2017 the Minister for Planning introduced a new provision within the State Planning Policy Framework (Clause 13.05-1) for all planning schemes in Victoria.
This new provision now requires the City to consider bushfire management for certain planning permit applications, such as subdivisions of more than 10 lots, regardless of whether the land is covered by a Bushfire Management Overlay under a planning scheme, or is designated as a bushfire prone area by the State Government.
